RICHARD A. WEST
Rich West is a New Jersey based attorney specializing in the representation of licensed professionals who are facing discipline by their licensing bodies. Most of the licensees are healthcare professionals but Rich also represents real estate brokers and agents, mortgage bankers, insurance agents, accountants, engineers and other professionals. Rich has extensive experience working with the licensing bodies, and works with clients to minimize the damage that can be caused by a disciplinary action. He negotiates the terms of disciplinary consent orders and appears on behalf of clients in administrative inquiries and hearings. He has successfully obtained license reinstatements across many boards for licensees with prior disciplinary actions. Rich regularly works with criminal attorneys to advise on the impact a criminal charge can have on a professional license. He also works with healthcare practitioners on regulatory compliance, privileges issues and insurance audits.
In addition to professional licensing matters, Rich also regularly represents companies and individuals facing litigation or regulatory action by the New Jersey Division of Consumer Affairs. He defends businesses in litigation or administrative actions by that agency. He has negotiated numerous consent orders with the DCA, resolving allegations of violations of the New Jersey Consumer Fraud Act. Rich acts as regular outside counsel to a large NJ automobile dealer group, defending Consumer Fraud Act claims, reviewing transactional documents and advertising for compliance with federal and state laws, and advising on manufacturer and lender issues.
Rich has previously been a guest lecturer for the Seton Hall Law School Skills for Health Care Law Practice course.
Prior to joining BMK, Rich ran his own solo practice and was previously a senior official with the New Jersey Division of Consumer Affairs. Rich started his career with the Sills Cummis firm in Newark.
